Maalampati Annapurna, 2022 (3) ALT 40 ( S.B. )SUBBA REDDY SATTI,j(1) Second appeal High Court in second appeal, while exercising jurisdiction under Section 100 of the CPC, must confine to the substantial question of law involved in the appeal and cannot re-appreciate the evidence.
(2) Profounder of the Will The profounder of the Will must remove the suspicious circumstances surrounding/shrouding the Will Though registration of Will by the testator is a strong circumstance to support the genuineness of the will, however, it does not by itself be sufficient to dispel of the suspicion.
(3) Suit for declaration of title Since, the suit is filed for declaration basing on Will, the other sons or daughters of Testator need not be arrayed as party defendants to the suit, unless they claim interest over the property by disputing the Will.
(4) Civil Procedure Code Section 100 – Indian Evidence Act, Section 68 – Succession Act, Section 63.
