Can you pl enlighten — wherein accused convicted for offence U/s.138 NI Act preferred an appeal. The Respondent/complainant said to have died (after closure of evidence on his side in trial court). The appellant/convict is not aware of death and it is not brought to the notice of trial court.
Now problem is the notices on deceased respondent/complainant cannot be served and he has no heirs. How to proceed with the appeal – and whom to be brought on record, when no one is coming forward to represent the complainant.
